Vaidya, President - "Whether in cases wherein the complainant, the purchaser of the flat alleges serious defects in building construction and the corresponding deficiency in service against the opponent builders, the appointment of technical expert by the Consumer Disputes Redressal Forum directing him to make on the spot investigation of the flat in respect of which defects have been alleged and report back his findings alongwith the corresponding estimated cost of removing the same, can it be said to be illegal, being contrary to sub-section(4) of Section 13 of the Consumer Protection Act, 1986 l(Act for short) and in that view of the matter also contrary to the Civil Procedure Code, 1963, warranting any interference for quashing and setting aside the same?" This important question arises for our consideration in the backdrop of the following facts situation.
