Nag, President-This appeal is directed against the order of the District Forum, whereby the District Forum has directed the appellants-M/S Reprographics Division HCL Ltd. to replace the photocopier by doing installation of a new photocopier at their own risk and cost in the premises of the complainant, failing which, the complainant shall be entitled to get the refund of Rs. 1,05,000/- the price paid by the complainant to the appellants for the purchase of photostat machine alongwith interest @ 18% per annum from the date of filing the complaint i.e. 9-10-1993 and a compensation of Rs. 44,300/- alongwith the cost of Rs. 2,000/-.

The brief relevant facts need to be stated are that respondent/complainant Mr. Sanjay Kumar Sharma(hereinafter to be referred to as the complainant purchased photostat machine from the appellants/ opposite parties(hereinafter to be referred to as the opposite parties) which was installed at the premises of the complainant M/S Sanjay General Store. Dalhousie. The warranty period of this machine was 3 months which expired on 1-9-1993. According to the complainant ever since the installation of this machine at his shop at Dalhousie, it never functi
