Life Insurance Corporation of India – Appellant

ORDER

Jasbir Singh, Member - Pawan Kumar Singla, who died on 23-11-1994 had taken the following insurance policies on his life.

1. 130985316 for Rs. 1,00,000/commencing as on 28-6-1994 proposed on 24-7-1994

2. 130986063 for Rs. 5,000/commencing as on 28-10-1994 proposed on 27- 10-1994.

2. These policies were under Double Endorsement Plan, with provision of payment of additional payment equal to the sum insured specified in the schedule of the policy in the event of the assured death prior to the date of maturity together with acquired bonus. The insured duly paid the premium during the subsistence of policy. The complainant which is the father of the deceased preferred a claim, but the opposite party, L.I.C. repudiated its liability on the ground the insured had suppressed the material information/facts about his health at the time of taking the policies. The insured committed suicide which fact the claimant was fraudulently trying to supress, and as per conditions of the policies, no amount was payable thereunder. Policy no. 130986063 not covered under the Double Endorsement plan.

3. Both the parties led their evidence on affidavits and documents which resulted in passing the impugned
