K.C. Shargava, President - Both these appeals have been filed against the judgment and order dated 9-12-1998 passed by District Forum, Allahabad in complaint case No. 1034/1996. These appeals have peen decided by a common judgment as they arise out of the same judgment.
2. The facts of the case stated in brief are that the complainant filed a complaint for a sum of Rs. 1,00,000/- as compensation for mental and physical torture against the appellant No.1 and Rs. 1,00,000/- on the same grounds against appellant No.2 which affected the health of the complainant No.2 including physical growth and development of the child and a sum of Rs. 10,000/- as damages for financial loss of complainant No.1.
3. Master Sarthak Pradhan, s/o Mr. Atul Pradhan, when he was only 1- 1/2 years old, was admitted to Nazareth Hospital, Allahabad and was treated under the supervision of Dr. R.N. Mehrotra, opposite party No.2. He was discharged on 12-9-1994 and certificate of discharge was also issued. Certain medicines and injections were prescribed by OP No. 1 to the minor applicant No.2.
