Padmaben Haribhai Parmar – Appellant

ORDER(ORAL)

S.A. Shah, President - The complainant is the widow of deceased Haribhai Parmar who has taken insurance from the opposite party for the amount of Rs. 50,000/- under the money back scheme. The policy No. is 830521056 dated 20.2.1990. The copy of the policy is produced at Exh. 1. It appears that after taking the policy he had some cough and was taking medicines. Ultimately, the husband of the complainant died on 28.10.1991 on account of cancer. The complainant has averred in para 3 of the complaint that when insurance was taken on 20.2.1990 her husband was hale and hearty. The medical examination was made by the doctor of the Insurance Company in which he was declared to be healthy. The complainant states that she has only 4 daughters and no male member to earn and by repudiation of the claim she has suffered mental agony, hardship and great inconvenience on account of non-receipt of insurance amount. '.

2. The Insurance Company appears to have repudiated the claim vide its letter dated 31.3.1992 on the ground that the answer given by the insured that he was possessing good health was false. Further allegation was made that when the proposal was made, the husband of the com
