ORDER

G.G. Loney, President. - This appeal is against the order of District Forum, Wardha dated 18.2.1992 passed in Complaint No. 42/91. The complainant alleged in his complaint that he booked L.P.Gas connection on 1.3.1986 with M/s. Anil Gas Agency, Wardha. He received intimation on 6.8.1989 for obtaining gas connection. The complainant alleged thin M/s. Anil Gas Agencies insisted the complainant to purchase gas stove and lighter compulsorily from him. The complainant, therefore, claimed Rs. 12,200/- as compensation.

2. The Opposite party opposed the complaint on the ground that the complainant did not turn up to collect the gas connection within a period of 90 days and, therefore, his allotment was cancelled.

3. We have heard the complainant in person. The respondent No.1 by Shri Mokashi and Respondent No.2 and 3 by Shri Thakkar, Advocate were present

4. The District Forum relying on the view taken by the Karnatak State Commission in the case of Vinayak Agencies and another v. DN. Shridhar1, held that the complainant was not a consumer within the meaning of Section 2(1)(d) of the C.P. Act 1986. Reliance is also placed on a decision of the National Commission, New Delhi in the case of
