Mrs. J. Nag, President - The petitioner is an educated unemployed youth belonging to Scheduled Tribe residing at the ancestral house of his late grandfather Thallan Sardar. The premises being "Ashok Bhavan", No.12 S.S. Road(also known as M.V. Road) with its annexe at 12/A S.S. Road, under Kurseong Municipality District Darjeeling. His complain is that for the last five years beginning from 1987 onwards his family is suffering from acute shortage of water supply due to the negligence of the said Kurseong Municipality.
2. The Petitioner's repeated requests did not yield any result. Even the appeal of the Councillor-in-Charge, Public Health Engineering Deptt. Darjeeling Gorkha Hill Council in this respect was not considered. As a result for the last five years the petitioner is procuring regularly potable water by carrier on payment of exhorbitant remuneration. This caused not only financial loss but also due to this negligence and deficiency of service by the Kurseong Municipality the petitioner suffered mentally. Further, he could not also lead an independent life by way of utilising not more than fifty per cent of his residence for any other purpose to earn his livelihood. His
