ORDER

P.M. Chauhan, President - This appeal is directed against the order by the District Consumer Disputes Redressal Forum, Mehsana quashing the bill dated] .5.1992 for Rs. 6184/- for 5830 calls and directing the appellant to issue new bill or to amend the original bill for 3500 calls observing that the bills for previous period and subsequent to the disputed period were much less. The undisputed bill for 1.3.1992 was for Rs. 1691/ - which was for 2747 calls and giving concession to the Telephone Department, the bill in question which is for 5830 calls should be revised considering 25% non-use of the telephone. The main grievance of the appellant is that the District Consumer Disputes Redressal Forum has mainly relied on the comparison of the previous and subsequent bills but has not taken into consideration the contention that there was no technical defect either in the line or meter and the bill was only because of the use of the telephone.

2. The grievance of the complainant respondent was that the bill dated 1.5.1992 for the period from 15.2.1992 to 15.4.1992 for Rs. 6184/- was excessive, wrong and considering Rs. 200/- for the rent and average bill of Rs. 1000/- the amount of R
