Headnote:Consumer Protection Act, 1986 - Sections 2 & 14 - Complainant booked Montana Car with opponent No.2, dealer of the first opponent and deposited booking amount Rs. 10,000/ - on assurance that car shall be delivered within six months - Price of the car informed by dealer was Rs. 98,000/ - - A further payment of Rs. 1,06,650/- made by complainant as price of the car - Opposite party No.1 then demanded further payment of Rs. 8,374/- being the price difference - No reason for the unilateral charge of price given - Opposite party remained absent before the Forum and opposite party failed to produce its dealership agreement and account books inspite of order from Commission - Delivery of the car should have been effected within a short time of receipt of full payment which opposite party No.1 failed - Complainant is entitled for the delivery of the car or in alternative return of the amount paid with 18% interest.

       Result - Complaint allowed with cost Rs. 1,000/-. Opposite party No.1 directed to pay Rs.

       5,000/- by way of damages for pain and suffering.
