Headnote:(i) Consumer Protection Act, 1986 – Sections 2(1)(c)(iii) and 2(1)(d)(ii) - Consumer or Bank Services - Complaint by respondent who is a member or Co-operative Bank and holding a Saving Bank Account -: Whether a consumer and his complaint whether maintainable? (Yes to both). (Para 5)

       (ii) Consumer Protection Act, 1986 Sections 2(1)(g) and 14(1)(c) and (1)(d) Complainant deposited sum in Bank - No withdrawal proved - Order of District Forum IS to repayment with interest and damages Whether correct? (Yes).

       Held: There have been irregularities and defalcations in the Bank, subscriber and members are not responsible therefor. PW1 has deposited Rs. 47,000/- under his pass-book, Exhibit A1 and is entitled to that amount and the District Forum has rightly found the point in his favour. (Para 6)

       IMPORTANT POINT

       A member of the Co-operative Bank holding a Saving Bank Account is a consumer so far as Bank is concerned and is entitled to file complaint for deficiency in its service.
