S.A. Kader, President This is a complaint under Section 12 read with Section 17 of the Consumer Protection Act.
2. The complainant is an Engineering concern engaging in the business of sale and installation of mechanical agitators used in blending units for the production of arrack. The complainant had a contract with the Tamilnadu Spirit Corporation for the supply and erection of three agitators in the Mettupalayam unit of Tamilnadu Spirit Corporation. The complainant-company supplied all the machineries excepting the gear box which is vital component. One gear box was delivered by the complainant to the opposite party in their Vadapalani agency on 17.6.1991 to be transported to and delivered to the complainant at Mettupalayam. The consignment did not reach the destination. Consequently the order for the installation of the agitators was cancelled by the Tamil Nadu Spirit Corporation by their letter dated 26.6.1990 and the complainant had to take back all the machineries.
