Pothuri Venkateswara Rao, Member— This is an appeal preferred by Sri Bhagwan of Hyderabad against the order of the Hyderabad District Forum in C.D. No. 60 of 1989 in which the complainant who is the appellant herein, alleged that M/s. Sri Krishna Jewelers, the respondent herein sold an ornament of gold with impurity, collected gold rate for the alleged impurity, while billing added an extra weight 0.680 grams to the actual weight of the ornament and charged for it.
2. The facts of the case are as follows: Sri Bhagwan purchased a gold chain of 22 carat purity, weighing 13.600 grams from Sri Krishna Jewelers on July 28, 1989. While billing, the opposite party added 0.680 grams to the actual weight of the ornament and charged for it. The bill worked out to a total of Rs. 4,760/-. The contention of the complainant was that the gold of the chain contained impurity and the jewelers charged gold rate for the impurity also. According to the appellant, addition of 0.680 grams to the actual weight of the chain and charging for the same is not justified. The appellant sought refund of the amount allegedly collected in excess and also claimed a sum of Rs. 500/- by way of damages.
