JUDGMENT

S.C. Mohapatra, President— Deficiency in service is grievance of the complainant.

2. Complainant resides with his wife in a Government quarters provided to her as Associate Professor of Paediatrics. On 21.1 0.1990 at about 7 P.M. when complainant was crossing the road leading from Mangalabag Police Station to Orissa School of Engineering passing on the western side of the college campus from the Government quarters on the other side of the road to the College campus side, a Motor cycle coming from Mangalabag side dashed against him. He was hospitalized on account of the accident. It was found that his left hip joint had been fractured. Asserting that the accident was Oil account of bad maintenance of the road which is deficiency in service rendered to him by opposite parties, he has filed this complaint. Complainant has asserted that the road has two lanes. One of the lanes has become useless for the traffic since the same is not maintained and is not kept free from encroachment and obstructions. He has described that for more than 3 years, right lane of the road is not in usable condition for which Executive Officer of the Cuttack Municipality is responsible as Cuttack Muni
