Sethulekshmi Member - This appeal is filed by the Divisional Manager of United India Insurance Company Ltd., Ernakulam against an order-dated 19.10.1990 of the Consumer Disputes Redressal District Forum, Idukky in OP. No. IDK/35/90 allowing the respondent to realise from the appellant a sum of Rs.2,2501- together with interest at 12% per annum from 29.6,1989 with costs of Rs.50/-.
2. The facts of the case, in so far as they are necessary for understanding the contentions raised in this appeal may be shortly stated.
3. On 25.2.1987 the respondent insured his cow for an amount of Rs.3,000/- with the appellant through their agent veterinary Doctor Gopinanthan. Subsequently the cow became sick and in spite of the treatment it had become permanently sterile and the matter was duly reported and the claim was put before the Appellant. On the basis of that claim, Company Doctor Baiju came and inspected the cow on 25.5.1988 and on his direction the cow was sold. Subsequently the Appellant refused to satisfy the Respondent's claim, which amounts to 75% of the insured amount.
