S.A. Kader, J.- This is a complaint under Section 17 read with Section 12 of the Consumer Protection Act.
2. The complainant is a company incorporated under the Indian Companies Act, and his having his office and place of business at Tuticorin. It purchased from the opposite party with the loan advanced by the Tamil Nadu Industrial Investment Corporation, Polymer 45 m.m./PP/HDPE Box strapping plant with special attachment for the manufacture of cane wire and monofilament, hanking machine for monofilament winding for a sum of Rs. 4,53,904. The manufacturer - opposite party is also bound to attend to any deficiency in working of the machinery as part of the sale consideration. The machineries were delivered in January '89 and according to the complainant, the commissioning of the machineries was delayed due to fact that the opposite party did not send the concerned engineers for commissioning. From June '89, the machine did not work properly and the complainant experienced problems as follows:(i) the coupling to fix the dye is sagging due to pressure by the screw and hence this coupling has to be replaced by a heavier one, ii) two lines are impressed in the tape continuously and
