R.N. Mittal, President. This appeal has been filed by the complainant against the order of the District Forum-I by which his claim for Rs. 23.385/- has been rejected.
2. Briefly the facts are that the complainant travelled by Indian Airlines Plane from Bombay to Bangalore by Flight No. IC 007 dated 3rd June, 1990. He handed over one Safari Suitcase at the check-counter to the respondent for carriage to Bangalore. When he reached Bangalore it was found that the suitcase was missing. Consequently, complainant lodged a complaint for recovery of Rs. 24,985/- as loss suffered as detailed in Annexure 'A'. He stated that an amount of Rs. 1,600/- had been paid by the respondent to him. After deducting the amount of Rs. 1,600/-, he claimed Rs. 23,385/.
3. The complaint has been contested by the respondent. It has been pleaded by them that according to the regulations framed under the Air Corporations Act 1953, the complainant was entitled to get Rs. 160 perkg. In view of that rule the complainant was paid Rs. 1,600/-. The District Forum dismissed the complaint. The complainant has come up in appeal.
