ORDER

Prof. Sunil Kanti Kar, Member - This appeal is directed against the judgment and order of the Calcutta District Forum passed in C.D.F. Case No. 243 of 1990 and C.D.F. Case No. 550 of 1990, allowing the petition of complaint. The case of the complainant who is respondent in this appeal is that the complainant had one S.B. NC. bearing No. 638 in joint names of herself and her husband Sri Ashok Kumar Srivastava and the complainant had other four recurring deposit accounts bearing Nos. 84/Q/166, 84/Q/80, 6O/Q 216 and 6/Q 274 in joint names of herself and her husband but as the said Ashok Kumar Srivastava stood as guarantor for his brother Sri Dilip Kumar Srivastava who took loan for his business firm M/ s. Associated Enterprise. As said Dilip Kumar Srivastava could not repay the loan to the appellant/bank, on the basis of general lien allegedly to have hold over S.B. Account and recurring deposit accounts standing in joint names as aforesaid bank attached and/or adjusted the amount of the said S.B. and recurring deposit accounts for keeping lien or charge on them.
