D.R. Vithal Rao, President - In this complaint the complainant has sought a sum of Rs.3,01,678/- as compensation from the Opp. Parties - the Oriental Insurance Co.
2. The complainant is the owner of a Saw Mill- M/s. Super Teak Wood Industries, Gundmi. The complainant obtained an Insurance Policy, a fire insurance policy from the Opp. parties and period of the policy was from 21st March, 1990 to 20th March, 1991.
3. It is the case of the complainant that by about 11.30 P.M. on 25.5.1990 during the currency of the policy there was lightening and thunders followed by heavy rains in Gundmi area. The Saw Mill of the complainant was hit by lightening and so certain electrical installations got dam-aged.
4. The complainant immediately made a report of the occurrence to the policy at Kota and also made a report of the occurrence to the 1st Opp. party and also submitted claim petition claiming a sum of Rs. 32,778/- from the Opp. Parties.
5. The opp. parties did send a Surveyor who made his report as per Ex. R-4 but the Opp. Party - Insurance Company failed to settle the claim. So the complainant sought compensation in a sum of Rs. 1,00,000/- towards loss of the good-will; a sum of Rs. 1,1
