Appeal No. 169 of 2004

For the Appellants:Mr. Balwant Kukreja, Advocate.
For the Respondent: None.

Headnote:Consumer Protection Act, 1986—Sections 12 and 17—Public auction of Industrial plots and commercial sites by appellant under Self Financing Scheme—Respondent complainant was highest bidder in respect of one plot and deposited Rs. 1,75,380/- 10% of bid amount—Complainant failed to deposit balance amount within 30 days as per conditions of auction and amount deposited was forfeited—District Forum allowing complaint directed refund of amount with interest—Appeal—District Forum was not right in its findings that document RI containing terms and conditions of auction was not part of auction notice—Unsuitability of plot by its nature could not be a defence to be raised as complainant ought to have taken inspection of site before joining the auction—Impugned order could not be sustained—However if respondent approached appellant for refund of 10% of deposited amount, his request to be considered with open mind, entirely to just, fair and reasonable discretion of appellant. (Paras 5, 6, 9 and 10)
