Bachan Lal—Appellant
versus
Commissioner, Municipal Corporation, U.T. Chandigarh & Anr.—Respondents
Appeal Case No. 222 of 2005
Decided on 23-11-2005
Counsel for the parties :
For the Appellant :Mrs. Madhu P. Singh, Advocate.
For the Respondents:Mr. O.P. Dabla, Advocate.
Headnote:Consumer Protection Act, 1986 — Section 2(1)(g) — Deficiency in service — Water — Charging for supply of water on commercial basis, challenged — Premises in question is a commercial site — No challenge or protest made for 32 years — Charging for water supply on commercial basis, proper — No deficiency in service.
Facts of the case :
(A)Present appeal has been preferred against the dismissal of the complaint. The appellant herein challenged the issuance of bills for water consumption on the basis of commercial charges. The appellant contended that the ground floor of the building has water no connection as it is used as godown and water supply was being used for the first and second floors for residential purposes.
(B)The commission observed that the site in question was sanctioned on 11-8-1972. As per the letter, the ground floor was sanctioned for godown, first floor for office and 2nd floor for working room. The letter belies the stand of appellant that the Ist and 2nd floors were meant for residential purposes. Admittedly since 1972, appellant is being charged for water supply on commercial basis. The appellant did not whisper or make any protest for a long period of 32 years that he was being illegally charged on commercial basis. Since, the appellant has purchased commercial site and he had been granted permission to use it as commercial site, the levy of water consumption charges on commercial basis appears to be proper. Appeal is dismissed.
Result : Appeal dismissed.
K.C. Gupta, President — This appeal has been directed by the complainant against order dated 31-10-2005 passed by Consumer Disputes Redressal Forum-II, U.T. Chandigarh (hereinafter to be referred as District Consumer Forum), whereby his complaint was dismissed with no order as to costs.
