The following order of the Commission was delivered by Justice N.K. Jain, President :
By this complaint under Section 17 of the Consumer Protection Act 1986, complainant – Mrs. Veenita Chandok claims compensation Rs. 15 lakhs against opposite party No. 1 – Dr. Meera Sanghi for the medical negligence allegedly committed by the latter in the matter of treatment of the former.
2. The facts of this case as unfolded by the evidentiary material on record and which are more or less admitted by the parties, are these:
(I) Complainant a married woman aged about 24 years was admitted as a case of IUD on 24-8-2000 in Rao Maternity Home, Jabalpur (a unit of Jamdar Hospital Pvt. Ltd.). Her pelvic sonography done on 23-8-2000 revealed 14.5 weeks foetus with its head crumpled and no cardiac activity or movements. Her D&C was performed by opposite party/Dr. Meera Sanghi on 26-8-2000 around 10.30 a.m.. Dr. Mrs. Arti Jain, MD (Anesthesiology) administered anesthesia for the procedure. Another person present on the spot was K.C. Gupta, Operation Theatre Assistant. Perforation of uterus was suspected. Dr. K.C. Diwani, MS (General Surgery) a consultant surgeon of Mannulal J. Trust Hospital Jaba
