ORDER

M.K. Basu, President — This is an appeal directed against the order dt. 19/9/2003 passed by the North 24 Parganas District Consumer Forum in D.F.C. case No. 44 of 2003 rejecting a petition of the Complainant dt. 27-8-2003 praying for an order allowing her to adduce evidence in support of her case. Being aggrieved

by this order of rejecting the said Complainant has preferred the present appeal challenging the same as erroneous and liable to be set aside.

2. The Forum below has in the impugned order given elaborate reasons as to why such a petition could not be allowed at that late stage. After the complaint was filed on 19-2-2003 before the Forum, the O.Ps were notified and after they entered appearance and submitted their written versions the Forum fixed a date for hearing. On 3rd July 2003 the case was taken up for hearing. No evidence was adduced from the side of the Complainant. Then argument was heard as advanced on behalf of the Complainant in full on that date and 16th July 2003 was fixed for argument of the O.Ps. On that date however the Complainant filed written notes of arguments also and the same were accepted. Thereafter the argument as advanced by the O.Ps was heard
