Datta,(President):- This appeal is directed against the order of the Forum directing the present Appellant to replace the machine by a new one if the same is accepted by the Complainant and if not to make refund of the price of the said machine less half of amount borne by them for the purpose of testing the sample of water at the National Test House.

2. The Complainant approached the Forum with the following allegations:-

He purchased a water treatment plant known as Zeolite Ferro Treat at a cost of Rs. 3.012/-. There was usual warranty. After installation of the said machine and within the guarantee period it was found not functioning satisfactorily. Sample of water was drawn from it and sent to an authorised Laboratory for test. The report of test indicated that the performance of the machine was unsatisfactory. The matter was reported to the OP for replacement of the said machine. It is alleged that a new machine was replaced for the old one but after the installation the new machine became totally non-functioning. The Complainant directed the OP several times and asked for refund of the price of the machine but there was no response from the other side.
