ORDER

K.C. Bhargava, President:-This complaint has been filed for recovery of Rs. 8.00.000/- as damages on account of medical expenses operation fee test fee admission fee and other expenses incurred by the complainant and for mental torture and agony caused to the complainant and his minor children's aged 3-1/2 years and 7-1/2 years due to the unnatural death of his wife.

2. The facts of the case-stated in 'brief are that the complainant is the husband of the deceased Smt. Vinod Singh who died on 05-05-1997 during the operation conducted by the opposite Party No.2. Dr. P.R. Gupta. Surgeon Surgery Department Shanti Manglik Hospital Fatehabad Road. Agra. The complainant as per the advise of opposite party No. 2 regarding operation by Leproscopic Method for removal of the stone from Gall-bladder admitted his wife in May. 97 and after admitting his wife in hospital he deposited Rs. 200/- as admission fee and Rs. 235/- for blood and urine test. As per the advise of the opposite Party No.2 the complainant was assured that operation will be done by Leproscopic method and this method is very easy and safe and in such type of operation the patient is able to leave the premises within the 24
