JUDGMENT

S.K.M Lodha, President - The only question involved in this complaint is whether it can be entertained under the Consumer Protection Act, 1986("the Act" herein). The complainant lodged this complaint against opposite party No.1(M/s. Bangali Moorti Kalakar) and opposite party No. 2(Kalicharan Bhardwaj) before the State Commission on 6.5.1991 praying that the opposite parties may be directed to deliver the statue particulars of which have been mentioned in the agreement dated 2.4.1990 for which the order was given to the opposite parties and also to pay compensation to the tune of Rs.103,410/-. An alternative prayer was made that in case the opposite parties do not deliver the statue in accordance with the conditions of the agreement, the amount paid by the complainant may be ordered to be refunded together with interest and compensation as stated in the complaint. The agreement dated 2.4.1990 reads as under:

2. This agreement was executed by the son of opposite party No.2 on a letter pad and it is signed by him. The son who has signed the agreement has not been impleaded as opposite party. The complainant has stated' that at the time of the execution of the agreem
