K.K. Srivastava, President - In this appeal filed against order dated 17 -10-2003 passed in complaint case No. 246 of 2003 by District Consumer Disputes Redressal Forum-I, U.T. Chand igarh [for short hereinafter referred to as the District Forum], the contention of Shri Jitin Talwar, Authorised Representative of the appellant Mrs. Usha Rani is the notwithstanding the cheque No. 035919 dated 28-4-2001 drawn on Bank of Punjab, Sector 35-B, Chandigarh towards the premium for continuation of the previous policy being dishonored, the respondent - United India Assurance Company Limited [for short hereinafter referred to as the Insurance Company] was still liable to settle the claim of the appellant under the cover note issued by it regading the insurance of Maruti 800 car bearing registration No. CH-03A8156, Model-2000.
2. The previous policy, which was to expire, was sought to be continued for the further period from 30-4-2001 to 29-4-2002. The premium amount of Rs. 6,360/- was paid vide cheque dated 28-4-2001 aforesaid. The cover note No. 439156 was issued by the Respondent Insurance Company.
