ORDER(ORAL)

S.G. Deshmukh, Member—The present appeal is filed by the original opponent against the judgment and order dated 12.10.1998 passed by the District Consumer Forum, Jalgaon in complaint No. 29/1998.

2. The respondent/complainant filed the complaint before the District Consumer Forum, Jalgaon for excess billings with regard to the bills dated 1.10.1997 and 1.12.1997. It is also contention of the complainant that, the appellants have informed him on 6.10.1994 that, too many calls are being made from his telephone.

3. The appellant appeared and resisted the complaint and contended that, the telephone was used for STD-ISD facilities during the prescribed period. The complaint filed by the respondent was investigated in detail and according to the appellant, meter is found functioning well and no fault was detected during prescribed period. According to the appellant, there were excessive calls due to excessive use. The appellant also filed MLOE report showing heavy use of STD & ISD calls.

4. After going through the papers and hearing both the parties, the Forum below ordered to refer the Dispute to Arbitrator under Section 7(b) of the Indian Telegraph Act regarding the disputed
