JUDGMENT

K. C. Gupta, President—This appeal has been directed by the opposite parties against order dated 21.11.2007 passed by the Consumer Disputes Redressal Forum-II, U.T. Chandigarh(hereinafter to be referred as District Consumer Forum) vide which complaint of respondent Sonia K.(complainant) was accepted against appellants and they were directed to refund a sum of Rs.3,098 to the respondent which had been wrongly charged as bouncing and penal interest charges. They were further directed not to levy any charges in future in case the remaining post dated cheques issued by the respondent were duly paid by the paying bank on presentation. They were further directed to pay compensation of Rs.10,000 for harassment, mental agony, torture etc. and Rs.2,500 as litigation costs.

2. Briefly stated the facts are that respondent(complainant) had taken loan of Rs.32,000 at a monthly flat interest rate of 2.73% for a tenure of 28 months from G.E. Money/appellant No.1 which was sanctioned on 13.10.2006. As per terms, respondent was to repay the amount with interest in 28 equated monthly instalments of Rs.2,092 per month.
