JUDGMENT

K.C. Gupta, President—Briefly stated the facts are that complainant No. 1 is minor son while complainants No. 2 and 3 are his mother and father respectively. Complainant No.3 had been practising as an advocate at Guhla, District Kaithal for the last 10 years.

2. It was next averred that on 14.8.90 at about 2.00 p.m. complainant No.2 Smt. Harmeet Kaur having complainant No.1 in her womb, alongwith her husband complainant No.3 approached Civil Hospital, Kaithal for getting her baby delivered. When she reached hospital then respondent No.3 Dr. Ranjna Jain was on duty and she admitted complainant No.2 in the civil hospital, Kaithal for delivery as a paid patient. She directed the staff nurse-respondent No.4 Mrs. Saroj Kaushal to supervise complainant No.2 for the purpose of delivery.

3. It was further averred that after checking, respondents No.3 & 4 told that everything was normal and the delivery was expected to be normal one. However, complainants No.2 & 3 expressed apprehension that the delivery might not be normal but respondents No.3 & 4 assured that it was going to be normal delivery as they did not see any sign of complication.
