JUDGMENT

This is an appeal under Section15 of the Consumer Protection Act, 1986(hereinafter called the ‘Act’) against the judgment and order dated 6.10.2006 passed by the District Consumer Forum-I, Lucknow in complaint Case No. 344/2005.

2. The case was taken up in the revised list. Perused the memo of appeal, impugned judgment and order, other materials available on record as well as heard Ms. Ratna Singh, Advocate learned Counsel for the complainant Devendra Shukla. The impugned judgment and order has been assailed on the ground that while awarding the compensation, the learned District Forum erred in law and in fact holding that there was a deficiency in service committed by the appellant whereas no case whatsoever was made out for justifying such a conclusion.

3. In the instant case, the complainant took an admission in Roy Education Centre for XIl Commerce Standard for appearing in examination of the year 2005 from NIOS Board. He studied in coaching classes and paid fee but a day before the examination it was made known to he complainant by the Director past and present of the appellant education centre that his form has been rejected.
