Sunil Kumar Garg, President—This appeal has been filed by the complainant/appellant against order dated 23.7.07 passed by the District Forum, Bharatpur in complaint No. 493/2004 by which the complaint of the complainant was dismissed.
2. It arises in the following circumstances:
That the complainant/appellant had filed a complaint before the District Forum on 11.10.04 inter alia stating that her husband Deen Dayal Gautam, now deceased had taken a LIC policy for a sum of Rs. 1,00,000 on 15.6.01 bearing policy No. 193028062 from the respondents. It was preferred by the complainant being the wife and nominee of the deceased before the office of the respondents but that claim was repudiated by the respondents through letter dated 31.1.04 on the ground that prior to filling up the declaration form by the deceased on 15.6.01 the respondent had sufficient proof to prove the fact that prior to three years before 15.6.01 the deceased was suffering from Polycystic kidney disease for which he had consulted a medical man and had taken treatment in a hospital and since these facts were not disclosed by the deceased in his declaration form, therefore, deceased was made misstatement and wi
