Dr. P.D. Shenoy, Member—Respondent was the complainant before the District Forum. Complainant, Kashinath Marwadi, was working as Divisional Manager with the petitioner-Insurance Company. He had purchased a Mediclaim Policy from his company for a sum of Rs. 1,00,000/- for the period from 24.05.1997 to 23.05.1998. On 08.01.1998, the petitioner-Insurance Company sent a letter to the complainant and informed him that he could purchase a policy involving Coverage upto Rs. 3,00,000/- as per the Scheme of the petitioner. Accordingly, on 02.03.1998 complainant purchased the policy from the petitioner. On 17.06.1998 complainant suffered heart stroke, hence a bypass surgery was performed at Pune for which he incurred an expenditure of Rs. 2,36,206/-. The complainant preferred claim in terms of the Mediclaim Policy for reimbursement of medical expenses he had incurred in terms of the previous policy and also from the latest policy. They ordered payment of Rs.72,464/- only and the rest of the claim was repudiated.
2. Accordingly, he filed a consumer complaint in the District Consumer Forum Nasik claiming Rs. 2,36,206 + interest @ 24% per annum. This was contested by the Insurance Company
