S.G. Deshmukh, Presiding Judicial Member—The present appeal is filed by original complainant against the judgment and order dated 26.12.2000 in complaint case No. 182/99 passed by District Consumer Forum, Jalgaon.
2. Appellant/Complainant’s case before the Forum is that, her daughter Sangeeta had obtained life insurance policy of her own life for Rs.1 ,00,000/- on 28.11.1996 for the period of 25 years. The proposal for the policy was submitted on 15.11.1996. It is contended that, she died because of general haemorrhage on 25.12.1996. Appellant being her mother and nominee filed claim for the insurance amount. The claim had been repudiated by the appellant vide it’s letter dated 22.4.1999 on the ground that, deceased suppressed material particulars about her health while submitting the proposal. Thus, appellant approached the Forum.
3. Respondent appeared before the Forum and resisted the claim. Respondent contended that, deceased Sangeeta had suppressed material particulars about health and thus the claim was rightly repudiated. She died after 27 days of policy.
