B.K. Taimni, Member—These two revision petitions arise out of a common order passed by the State Consumer Disputes Redressal Commission, Haryana, Chandigarh dated 10.3.2008.
2. Undisputed facts of the case are that the petitioner/complainant, Shri R.K. Monga was the highest bidder for Kiosks bearing Nos. 121 and 122 situated at Sector-28, Faridabad, each measuring 8 × 8 sq. fts. for a consideration of Rs. 71,100/- each, allotment of which, was made in favour of the petitioner vide letter dated 15.2.1991.
3. It was the case of the complainant that since no development work has been done, he did not pay the remaining amount. Since the petitioner was not coming forward to deposit 15% price in addition to 10% price already paid and there was no offer of the petitioner to take possession, the Kiosks was resumed by order of the Estate Officer dated 26.3.2002 against which, an appeal was filed before the Administrator, HUDA, Faridabad exercising the powers of Chief Administrator, HUDA, which was dismissed.
