ORDER

G.D. Sharma, President—Order dated 29.05.2006 which is a common order passed (in complaint No. 50/2002 and complaint No. 58/2002) by the learned Divisional Forum Srinagar (hereinafter to be referred to as the Forum) has been challenged through the medium of this appeal. Complaint No. 50/2002 was filed by the insured (respondent herein) Mohd. Ismail Mir and complaint No. 58/2002 was filed by Abdul Gani Rather against the appellant herein before the Forum. The cause of the loss was floods which were stated to have been caused by excessive rains during the month of August 1996. The houses of the respondents alongwith kitchen as described in the impugned order were insured with the respondent under respective insurance policies which had come into operation from 8.8.96 and had to expire on 7.8.97. It was alleged that the floods had marooned the Village Lasjan and on 24.08.96 and loss was caused to the abovestated properties. The learned Forum has awarded compensation in complaint No. 50/2002 in the sum of Rs. 16570/- alongwith interest @ 6% per annum after three months from the date of surveyor report till its realization as well as Rs. 5000/- as compensation for sufferings of the
