Arun Kumar Goel, President—Controversy involved in this case is very limited. Reason being that vehicle bearing registration No. HP 23-A-7786 having been financed by the appellants on 31.5.2004 for Rs. 6,40,000 through its Branch Office at Mandi is admitted by both the parties. It is further made out from the record that the vehicle in question was repossessed by the appellants and is also again not in dispute. The amount was repayable with 4½% interest, in 36 equal monthly instalments of Rs. 20,178 each. A dispute having arisen regarding payment of Rs.20,178 that was deposited by the respondent, but was not being taken into consideration by appellant No.1 resulted in the vehicle being repossessed on 3.5.2005. It was taken into custody by the appellants from Ghumarwin by some unidentified person. When the respondent came to know, he lodged a First Information Report No. 70/2005. Respondent had approached the Additional Chief Judicial Magistrate, Ghumarwin for the release of the vehicle. Appellant No.1 also filed similar application. Papers of the vehicle viz.
