ORDER

Mrs. Jasbir Kapoor, Presiding Member—This is an appeal filed by State Bank of India (in short ‘the appellant’) against the order dated 8.8.2008 of the District Consumer Disputes Redressal Forum, Sangrur (in short the ‘District Forum’) by which the complaint of the complainant (in short ‘respondent No.1’) was allowed by the District Forum. The following is the operative part of the order:

“9. For these reasons therefore, we allow the complaint and direct the opposite party to:

(a) withdraw the demand of Rs. 3,15,000 (minus a sum of Rs. 44,087) in CC’s account which was given to Mr. Ajay Sharma vide cheque number 583194 dated 6.10.2006, and

(b) pay to the CC a sum of Rs.5,000 in lieu of consolidated amount of compensation,

10. This order of ours shall be complied with within 60 days of communication. Copy of the order be supplied to each party free of charge. File be consigned to records in due course.”

2. Brief facts of the case are that Sandeep Kumar Goyal, Proprietor of M/s Sandeep Medical Agency, Malerkotla had a bank account No. 10731512775 with the appellant bank and availed the cash credit limit of Rs.5,00,000 on behalf of respondent No.2. He was the dealer of M/
