Jain, Presiding Member—The present case relates to the alleged medical negligence in the treatment of a young woman, Saroj Mahesh Chand Katare, aged about 30 years who had walked into the Bombay Hospital hale and hearty except for a residual complaint of pain in her right ankle for which she underwent a surgical procedure for removal of fibular implant and right ankle arthrodesis but came out dead from the said Hospital, as she developed the life threatening complication of Pulmonary Embolism (PE) during the course of the operation. M.C. Katare (complainant) is the husband of the deceased Saroj Katare; opposite party no.1; Bombay Hospital and Medical Research Centre (hereinafter to be referred to as “the Hospital”) is a multi-specialty medical institute run and administered by a Trust constituted under the provisions of the Trusts Act; opposite party no.2, Dr. H. R. Jhunjhunwala (hereinafter to be referred to as “the Surgeon”) is a well known and highly experienced Orthopedic Surgeon of Mumbai who was attached well to the hospital as a Consultant and had conducted the above-mentioned surgery on the deceased patient.
