Mrs. Rajyalakshmi Rao, Member—The complainants Mrs. Kamlesh Singla and Mohan Singla filed this complaint against opposite parties No. 1 to 7, M/s Pan India Paryatan Limited—O.P. No.1; Subash Chandra—O.P. No. 2 Ashok Goel—O.P. No. 3; Puneet Goenka—O.P. No. 4; Jawahar Geol—O.P. No.5; Sunil Gudur—O.P. No. 6; and The New India Assurance Company Limited—O.P. No.7 alleging deficiency in service for causing death of their son Manish Singla and not compensating them for the incident.
2. It was alleged that on 4.2.1996 Manish Singla aged about 24 years purchased entry ticket of Rs.125/- and also ferry ticket of Rs. 10/- and entered the amusement park, Essel World, which is owned and managed by opposite parties nos.1 to 6. When Manish Singla was riding in ‘Aqua Dive’ amusement ride one of the apparatus’ installed by the opposite parties nos. 1 to 6 in the amusement park for the entertainment of public, the whole cart carrying six persons toppled and the train attached to it jolted suddenly throwing Manish Singla on the ground causing his death instantaneously.
