ORDER

Ashok Bhan, President—Petitioner, who was the complainant before the District Consumer Disputes Redressal Forum, Firozabad (hereinafter referred to as ‘the District Forum’ for short), has filed the present revision petition against the Order dated 26.4.2006 passed by the Uttar Pradesh State Consumer Disputes Redressal Commission, Lucknow (for short, ‘the State Commission’) wherein and whereunder the appeal of the respondent Bank was allowed and the Order of District Forum was set aside.

2. Shortly stated, the facts leading to the filing of the case are:

It is stated in the Complaint that the real uncle (Tauji) of the petitioner/complainant, Late Shri Sovarna Singh s/o Shri Tilak Singh R/o Village Bhaypur, Post-Milawali, District Firozabad, during his lifetime, had deposited Rs.53,000 on 16.12.1985 in his Bank Account No.10570 in respondent Bank. That since petitioner’s uncle was issueless and petitioner was at his disposal, Sovarna Singh had executed a Will dated 28.10.1991, bequeathing all his property-movable or immovable, after his death, to the petitioner/complainant.

3. It was alleged that in the year 1986, during the lifetime of Sovarna Singh, employees of respondent Ba
