S.N. Aggarwal, President—Manjit Singh respondent had taken two loans from the appellants and his loan account numbers were 560595822 and 560911257. At the time of sanctioning the loan, the appellants had taken blank cheques from the respondent as also original title deed of his property by way of security with the assurance that the same would be returned to the respondent after the clearance of the entire loan amounts.
2. It was further pleaded that the respondent had been making the payment of installments to the appellants from time to time. On 21.10.2009, an amount of Rs. 3,44,651/- was outstanding against the respondent in account .No. 560595822 and an amount of Rs. 1,89,628/- in account No. 560911257 as per the statement prepared by the appellants and furnished to the respondent.
3. It was further pleaded that the respondent deposited cheque No. 358208 dated 21.10.2009 for Rs. 1,89,628/- and another cheque No. 358207 dated 21.10.2009 for Rs. 3,44,651/- with the appellants for payment of the entire loan amount outstanding against the respondent. Nothing more was payable by the respondent to the appellants, thereafter.
