ORDER

Anupam Dasgupta, Presiding Member—This revision petition has been filed against the order dated 31.03.2011 of the Punjab State Consumer Disputes Redressal Commission, Chandigarh, (in short, ‘the State Commission’). By this order, the State Commission partly allowed the appeal of the respondent/complainant and directed the petitioner insurance company to pay Rs.5,75,000/-, minus the amount already paid, within one month from the date of receipt of the order along with interest @ 7.5 % per annum only on the remaining amount, with effect from 06.06.2004 (i.e., after three months from the date of accident) till the date of payment.

2. The facts are that the respondent bought a motor car for Rs.6,06,644/- on 02.03.2004 and got it insured for Rs.5,76,217/- (Insureds’ Declared Value – IDV)with the petitioner insurance company for the period 02.03.2004 to 01.03.2005. The car met with an accident on 05.03.2004 while being driven by the respondent and both he and his wife received serious injuries. On 06.03.2004, the surveyor appointed by the insurance company inspected the vehicle and assessed the loss on “total loss” basis, as the car was badly damaged.
