ORDER (ORAL)

S.C. Vyas, President—This order will govern disposal of Appeal Nos. 646/2009 and 654/2009, which have been preferred respectively by the complainant and the Branch Manager of the O.P. Insurance Company of Complaint Case No.154/2007. The complaint of the complainant was dismissed against the Insurance Company, but, the Manager of the Insurance Company, has been directed to pay an amount of Rs.1,10,000/- to the complainant from his pocket vide order dated 15/10/2009. Both parties felt aggrieved by the aforesaid order and challenged it by way of these two appeals. For convenience parties will be referred as complainant and O.Ps according to their status before the District Forum. Original of this order be retained in the file of Appeal No.646/2009 and it’s copy be placed in the record of Appeal No.654/2009.

2. It is not in dispute that Mahindra Scorpio vehicle No.M.P.20-HA-5081 was earlier registered under the ownership of Ayaz Ahmed and was insured by Oriental Insurance Company Limited under an insurance policy issued in favour of aforesaid Ayaz Ahmed. Later on the policy was transferred in the name of the complainant Vinay Kumar Singh on 20.06.2006 providing insurance co
