J. M. Malik, Presiding Member—Learned counsel for the petitioner present. Arguments heard.

2. Kanpur Development Authority, the opposite party in this case, allotted a house in favour of the complainant, Shri Zahir Ahmed. The said house was allotted on lease and the policy was decided as per the Government notification dated 16.6.1993. The petitioner was put in the possession of the house. The total tentative amount determined by the Government was Rs. 3,17,730/-. The complainant deposited an amount of Rs.88,000/- towards the ¼ of the cost of the house, on 22.3.1997. However, the OP did not execute the conveyance deed. The complainant further deposited a sum of Rs.9390/-, which is liable to be adjusted towards the sale price. The complainant requested in writing for deposit of the remaining amount and to execute the conveyance deed vide applications dated 28.10.1998, 30.11.1998, 3.3.2000, 22.10.2000 but the needful was not done.

3. Aggrieved by that, the complainant filed a writ petition before the Hon’ble High Court and the Hon’ble High Court vide its order dated 28.10.2009 passed the following order:
