Ajit Bharihoke, Presiding Member—This revision petition is directed against the order of Rajasthan State Consumer Disputes Redressal Commission, Jaipur (in short, “State Commission”) dated 1.10.2014 in appeal No.417 of 2014, whereby State Commission concurred with the findings of the District Forum awarding compensation to the respondent/complainant and dismissed the appeal.
2. Briefly put facts relevant for the disposal of this revision petition are that undisputedly the respondent purchased life insurance policy from the petitioner/opposite party. One of the condition of the policy was that in the event of the insured suffering from a critical illness, 180 days after coming into force of the insurance policy, the insurance company would pay her a sum of Rs.4 lakhs. The insurance policy came into force on 2.12.2009. On 19.4.2012, the complainant was diagnosed with heart problem and as per medical certificate, she was suffering from RHD – severe AR and was advised for Aortic Valve replacement involving open heart surgery with estimated expenditure of Rs.2 lakhs.
