ORDER :

This revision is directed against the order of the Jharkhand State Consumer Disputes Redressal Commission, Ranchi (in short, “the State Commission) dated 19.1.2015 in first appeal No.189/2011 whereby the State Commission dismissed the appeal preferred by the petitioner.

2. Briefly stated, facts relevant for the disposal of the revision petition are that the petitioner M/s Sthya Sai Agencies a partnership firm through its partner filed a consumer complaint against the respondent bank and M/s Jackson Laboratories (Pvt.) Ltd. alleging deficiency in service in respect of payment made by the bank to opposite party No.3 pursuant to an expired cheque which was purportedly revalidated to bring it within the limitation by allegedly appending forged signatures of the complainant.

3. Opposite parties contested the complaint on merits.

4. The District Forum, Ranchi on consideration of pleadings of the parties and the evidence dismissed the complaint on two counts, namely, that the consumer complaint was not maintainable as the petitioner is not a consumer as envisaged under Section 2 (1) (d) of the Consumer Protection Act, 198 and also on merits.
