This revision is directed against the order of the Punjab State Consumer Disputes Redressal Commission, Chandigarh (in short, “the State Commission”) dated 25.7.2012 in first appeal No.1661/2007 whereby the State Commission dismissed the appeal preferred by the petitioner/opposite party against the order of the District Forum, Sangrur.
2. Briefly put, facts relevant for the disposal of the revision petition are that Shri Ved Prakash Agarwal, husband of the respondent/complainant purchased a life insurance policy for a sum of Rs.4,90,000 from the petitioner/opposite party. The policy was valid w.e.f. 27.2.2006. Shri Ved Prakash Agarwal died due to heart attack on 21.6.2006. The respondent being the nominee/legal heir of late insured filed an insurance claim. The insurance claim, however, was repudiated by the petitioner company on the ground that the insurance policy was obtained by misrepresentation and concealment of material facts. Being aggrieved of the repudiation of the insurance claim, the respondent filed a consumer complaint in District Forum, Sangrur.
