IMPORTANT POINT
Suppression of pre-existing ailments may vitiate insurance cover.
Headnote:Consumer Protection Act, 1986—Sections 15, 17, 19 and 21—Insurance—Repudiation of death claim on ground of suppression of pre-existing ailments—Complaint dismissed by State Commission in appeal—Deceased, while taking insurance policy had clearly stated that he was not suffering from any liver disorder and had not attended any doctor or any other medical facility for investigation or diagnostic test—He also represented that he did not have any symptom or condition requiring consultation with a doctor in future—Deceased was a patient of chronic liver disease and portal hypertension—Since insurance policy was obtained by suppression of material facts and making a misrepresentation as regards state of health of insured who died within two years of taking policy, Insurance Company was fully justified in repudiating claim—Revision Petition dismissed.
