Petitioner/Opposite Party No.1 being aggrieved by impugned orders dated 17.10.2012 and 22.02.2013 passed by State Consumer Disputes Redressal Maharashtra, Mumbai (for short, ‘State Commission’) has filed this petition.
2. The impugned order dated 17.10.2012 read as under;
“Order
Heard Mr.A.S.Vidyarthi Advocate for Complainant and Ms. Nelam Jadhav for O.P. No.2. Opponent No. 2 has filed written version today, it is taken on record. Copy of the same is given to the Complainant. Now, written version of Opponent No. 2 is on record and the complaint has been proceeded ex-parte against Opponent No.1 in view of the order dated 09.08.2012. Therefore, we direct the complainant and Opponent No. 2 to lead their respective evidence under Section 13(4) of the Consumer Protection Act, 1986 by filing their affidavits and or/ or affidavits of their witnesses, if any. Parties are further directed to prepare their affidavits well in advance and serve the copies thereof before hand to the other side. On receipt of such affidavits from other side, the parties are at a liberty to file their counter affidavits, if any. Such counter affidavits shall also be prepared well in advance and copies there
