U.V. Bakre, President—This appeal is directed against the judgment and order dated 03/11/2015 passed by the Lr. Consumer Disputes Redressal Forum, North-Goa (“Forum” for short) in Consumer Complaint No. 114 of 2013, whereby the Appellants, jointly and severally, have been directed to replace the Honda CBR 250 of the same make and colour or in the alternative to refund to the Complainant the entire amount of Rs. 1,74, 178/- with interest @ 12% from the date of purchase till the final payment and further to pay Rs. 25,000/- towards mental stress and agony and Rs. 10,000/- towards cost.

2. The Appellants were the Opposite Parties (OPs) and Respondent was the Complainant before the Forum and they shall hereinafter be referred to in the same manner as their names appear in the cause title of the said Complaint.

3. Case of the Complainant, in short, is as follows:-

The Complainant had booked the aesteriod black metallic and silver metallic Honda CBR 250R STD (Two wheeler motorcycle with gear), and had made payment of the booking amount of Rs. 5,000/- as part payment towards the purchase of the said bike bearing serial booking No. 29843 on 18/09/2013.
